Terms of Service for IBMA Equip

1. Acceptance of Terms
By accessing or using the IBMA Equip E-Learning platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all users, including students, instructors, and administrators.
2. User Accounts
a. Registration: To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
b. Account Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use a "strong" password (a password that uses a combination of upper and lower case letters, numbers, and symbols). IBMA Equip cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
c. Social Logins: If you choose to register or log in using a third-party service (e.g., Google, Facebook), you authorize us to access and use certain account information from that service, as permitted by that service and as described in our Privacy Policy.
3. User Conduct and Responsibilities
You agree not to misuse the Service. For example, you must not, and must not attempt to, do the following:
- Share your account credentials or provide access to your account to any third party.
- Use the Service for any illegal or unauthorized purpose.
- Post or transmit any content that is infringing, libelous, defamatory, obscene, pornographic, or abusive.
- Attempt to circumvent any content-filtering techniques we employ, or attempt to access any service or area of the Service that you are not authorized to access.
- Probe, scan, or test the vulnerability of any system or network or breach any security or authentication measures.
4. Intellectual Property
All materials on the Service, including, but not limited to, text, graphics, videos, logos, and course content (the " Content"), are the property of IBMA Equip or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and view the Content for your personal, non-commercial, educational purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of the Content in whole or in part without our prior written consent.
5. Subscriptions and Bandwidth
a. Subscriptions: Certain features of the Service, including access to video content, may require an active subscription. By purchasing a subscription, you agree to pay the specified fees.
b. Bandwidth Usage: Your subscription may include a specific data or bandwidth allowance for streaming video content. You acknowledge that streaming videos consumes this allowance. We reserve the right to suspend or terminate video streaming services if your bandwidth allowance is depleted. It is your responsibility to monitor your usage.
6. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
In no event shall IBMA Equip, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page and updating the "Last Updated" date.
